Donation Terms and Conditions – Onne Medical Outreach
Afiyavest Community Health Initiative (ACHI)
A program of Afiyavest Technology Solutions Ltd. (“Afiyavest”, “we”, “us”, or “our”)
Effective date: 1st September 2025
1. Acceptance of Terms
By making a donation on this page, you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not donate.
2. Definitions
- Donation: A voluntary monetary gift made without receiving goods or services in return.
- Donor or you: The person or organisation making a donation.
- Onne Medical Outreach: ACHI programme activities intended for Onne, Rivers State, Nigeria.
3. Purpose and Use of Funds
Donations support ACHI’s charitable purposes, including planning, delivery, and follow-up for the Onne Medical Outreach and related health initiatives. If needs change, Afiyavest may apply funds to the closest related purpose within ACHI’s mandate. If you state a restriction that Afiyavest accepts in writing, we will use reasonable efforts to honour it. If it cannot be fulfilled, we may apply the funds to a similar purpose.
4. No Goods or Services; Tax Matters
No goods or services are provided in exchange for your donation. Afiyavest does not provide tax advice. Please seek your own advice.
5. Non-Refundable Donations
All donations are non-refundable, except where required by law or in cases of verified processing error or fraud.
6. Event Date and Programme Changes
The Onne Medical Outreach may be postponed, rescheduled, modified, or cancelled due to factors beyond our control. If the date changes, your donation will remain designated for the outreach or a closely related ACHI purpose as set out in Section 3.
7. Eligibility and Donor Warranties
- You are at least 18 years old, or you are authorised to donate on behalf of an organisation.
- Your donation is lawful and does not violate anti-money laundering or counter-terrorist financing laws.
- Afiyavest may decline, return, or report donations that appear non-compliant with law or our policies.
8. Payment Processing
Donations may be made by bank transfer or other supported methods. You authorise processing in the currency and amount selected. Bank charges, exchange rates, and transfer fees are your responsibility. A receipt will be provided if you share contact details.
9. Personal Information and Privacy
By donating, you consent to Afiyavest collecting and processing your personal information (name, contact details, payment references) to: process donations and receipts, manage donor relations, meet legal and audit needs, and contact you about ACHI activities (you may opt out). We comply with applicable laws, including the Nigeria Data Protection Regulation 2019 (NDPR). We may share data with service providers under appropriate safeguards. We do not sell donor data. 10. Communications Preferences
We may share updates on impact, future campaigns, and reports. You can opt out of non-essential communications at any time.
11. Reporting and Transparency
Afiyavest will provide public updates and reports on resource use through our website, social channels, or publications, subject to confidentiality and security considerations. Individualised reports may not be available to all donors.
12. Right to Refuse, Suspend, or Close Campaigns
We may refuse any donation or suspend/close any fundraising campaign that conflicts with legal requirements, our values, or operational priorities. Where appropriate, refused donations will be returned to the source account, net of non-recoverable charges.
13. Website Use; Liability and Disclaimers
The donation page is provided “as is.” While we strive for accuracy, we do not guarantee uninterrupted or error-free operation. To the extent allowed by law, Afiyavest and its officers, employees, and agents are not liable for indirect, incidental, special, or consequential damages related to website use or donations. Nothing excludes liability that cannot be excluded by law.
14. Intellectual Property
All names, trademarks, and content are owned by Afiyavest or used under licence. Do not use them without written permission.
15. Compliance and Investigations
We may take steps needed to comply with law, regulator requests, audit requirements, or to investigate suspected fraud or misuse.
16. Changes to These Terms
We may amend these Terms at any time. Updated Terms apply to donations made after the new effective date. Material changes may be highlighted on this page.
17. Third-Party Links and Services
Third-party sites and services have their own content and privacy practices. We are not responsible for them.
18. Termination
We may suspend or terminate page access for maintenance, security, legal, or operational reasons.
19. No Third-Party Rights
These Terms are between you and Afiyavest. No other person has rights to enforce them.
20. Severability
If any provision is invalid or unenforceable, the rest remains in force.
21. Entire Agreement
These Terms and the referenced policies (including the Privacy Policy) form the entire agreement for donations made through this page.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. You agree to the exclusive jurisdiction of the courts of Rivers State, Nigeria.
